By creating an account or using any part of the ViralSendr platform (“Service”), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service. We may update these Terms and continued use after changes constitutes acceptance.

ViralSendr provides an AI-powered social media content generation platform. Users can generate platform-optimized captions, hashtags, and posts for Instagram, X (Twitter), LinkedIn, TikTok, Facebook, and other platforms. The Service is offered on a subscription basis as described on our pricing page. Features may change over time. We will provide reasonable notice for material changes.

You must register with a valid email address and are responsible for: providing accurate information, maintaining password confidentiality, all activities under your account, and notifying us of unauthorized access. You must be at least 16 years old to use the Service.

Paid subscriptions are billed in advance monthly or annually. Billing: Charges apply to your payment method on the billing date. Prices are exclusive of applicable taxes. Cancellation: Cancel anytime from account settings. Access continues until end of the billing period. Refunds: No refunds for partial periods except as required by law. Contact billing@viralsendr.com within 14 days for billing errors. Price changes: 30 days' notice before price changes take effect at your next renewal. Unpaid invoices: We may suspend paid features if payment fails.

You must not use the Service to: • Generate illegal, defamatory, fraudulent, harassing, or hateful content • Create spam, phishing content, or disinformation campaigns • Abuse free trial provisions or create multiple accounts for additional free usage • Reverse engineer or extract source code from our software • Use automated scripts or bots without written permission • Resell or sublicense access without authorization • Violate privacy, intellectual property, or other rights of any person We reserve the right to investigate violations and terminate accounts.

Content accuracy: AI-generated content may contain errors. You are responsible for reviewing content before publishing. Your ownership: AI-generated content created with your prompts is owned by you, subject to these Terms. No uniqueness guarantee: We cannot guarantee that generated content is entirely unique. Not professional advice: Content does not constitute legal, medical, financial, or marketing advice. Prohibited inputs: Do not submit confidential personal data or trade secrets you cannot process through third-party AI services. Platform compliance: You are responsible for ensuring generated content complies with the terms of each social media platform on which you publish.

Our IP: The ViralSendr platform, software, design, and brand are protected by intellectual property law. No reproduction or derivative works without written consent. Your content: You retain ownership of prompts and materials you provide. You grant us a limited license to process your content to provide the Service. Feedback: Ideas and suggestions you submit may be used by us without compensation.

Your use of the Service is governed by our Privacy Policy, incorporated into these Terms by reference.

The Service is provided "as is" and "as available." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, ViralSendr shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, or data. Our total liability shall not exceed the amount you paid us in the three months preceding the claim.

You may delete your account at any time. We may suspend or terminate access for breach of these Terms, non-payment, or harmful conduct. Data is removed per our Privacy Policy upon account deletion.

These Terms are governed by the laws of [Jurisdiction]. Disputes shall be resolved in the courts of [Jurisdiction]. EU consumers may also use the EU ODR platform at https://ec.europa.eu/consumers/odr.
